Terms of Use

Last updated October 13, 2026

These Terms of Use explain the rules for using the Nelson Digital LLC website, contacting us, and requesting a consultation. Nelson Digital LLC provides custom web design, responsive development, and e-commerce solutions.

Please read these terms before using our website. If you do not agree with them, please stop using the site. Questions can be sent to aidan@nelsonwebstudio.com.

01. What these terms cover

These terms apply to this website and the information and inquiry features available through it. They do not replace a written proposal, service agreement, or other agreement for a client project.

If you contact us on behalf of a business, you are responsible for having authority to make the inquiry and provide information on that business's behalf. You must have the legal capacity to enter into any separate agreement you accept with us.

02. Acceptable use

You may browse the website, learn about our services, and contact us for legitimate business purposes. Use the site lawfully and respect the rights of others.

You must not use the website to submit fraudulent, unlawful, abusive, or infringing material; impersonate someone else; distribute spam or malicious software; attempt unauthorized access; interfere with the website's operation; or bypass its security controls. Automated activity that disrupts the site or collects personal information without a lawful basis is also prohibited.

Nothing in these terms restricts activity that applicable law expressly permits.

03. Website content and ownership

The text, branding, graphics, designs, images, and other material on this website belong to Nelson Digital LLC or their respective owners and licensors, except where otherwise stated.

You may view the site and retain a reasonable copy of information for your own evaluation of our services. Except as permitted by law or an applicable license, you may not reproduce, sell, redistribute, modify, or use our branding or website content commercially without permission. Do not remove ownership notices or suggest that we endorse your business without authorization.

Client names, logos, and third-party materials remain the property of their respective owners. Ownership and licensing of work created for a client are governed by the relevant project agreement.

04. Information you submit

When you contact us or request a consultation, provide accurate information that you are authorized to share. You remain responsible for the material you send, including business details, text, images, and project requirements.

You retain ownership of your submitted material. You authorize us to use it only as reasonably needed to respond to your inquiry, assess your project, or provide services you request, subject to our Privacy Policy and any separate agreement. Sending an inquiry does not give us permission to publish your confidential material or use it in our portfolio.

Please do not send passwords, payment card details, or sensitive personal information through general contact forms or email. If a project requires access to an account or confidential material, we will agree on an appropriate method separately.

05. Consultations and inquiries

An inquiry, appointment request, or consultation does not by itself create a paid engagement, guarantee project availability, or require either party to proceed with a project. Any charges and the work to be performed must be agreed separately.

We use Google Calendar and Google Meet for scheduling and consultations. Please provide accurate contact details, attend at the agreed time, and let us know promptly if you need to reschedule or cancel. Appointment times and availability are subject to confirmation.

A consultation provides an opportunity to discuss your goals. It is not legal, tax, financial, or other regulated professional advice.

06. Client project agreements

Before paid project work begins, the relevant proposal or service agreement should identify the scope of work, deliverables, pricing, payment schedule, responsibilities, and any applicable timelines.

That agreement governs matters such as deposits, revisions, additional work, client approvals, third-party costs, ownership or licensing of deliverables, ongoing support, cancellation, and refunds. These website terms do not establish a non-refundable deposit, a revision allowance, or a cancellation fee.

Where a project agreement conflicts with these terms on a project-specific matter, the project agreement controls to the extent permitted by law. Any change to an existing client agreement must follow that agreement's change process.

07. Third-party services and privacy

Our website may link to or rely on third-party platforms, including Squarespace, Google Calendar, and Google Meet. Those providers operate their own services and may apply separate terms, privacy policies, fees, and availability requirements. Review their terms before using their services.

We do not control external websites or guarantee the availability or accuracy of third-party services. A link does not by itself imply endorsement of all content on an external site.

Our Privacy Policy explains how we handle personal information collected through this website and our business communications. These Terms of Use do not waive your privacy rights.

08. Website information and results

We aim to keep our website accurate and current, but content may contain errors or become outdated. Service descriptions are general information; your agreed project scope and pricing are set out separately.

Examples, portfolio work, and descriptions of potential benefits are not guarantees of a particular result. Website performance, search rankings, traffic, conversions, revenue, and third-party approval depend on factors that vary between businesses. Any express commitments we make in a project agreement remain governed by that agreement.

If you notice an error or need clarification before making a decision, please contact us.

09. Availability and disclaimers

We may update, maintain, or temporarily suspend website features. We do not guarantee uninterrupted access or that the site will always be free of errors or harmful components.

To the extent permitted by applicable law, this website and its general informational content are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. This disclaimer concerns the website and does not override an express warranty in a separate client agreement or a right that cannot legally be excluded.

10. Limits of liability

To the extent permitted by applicable law, Nelson Digital LLC is not liable for indirect, incidental, special, or consequential losses arising from your use of, or inability to use, this website, including lost profits, business opportunities, or data.

This limitation does not exclude liability for fraud, willful misconduct, or any liability that applicable law does not allow us to exclude or limit. It does not replace the liability provisions of a separate client agreement. If a limitation is not permitted in your jurisdiction, it applies only to the extent lawful.

11. Concerns, access, and legal rights

If you have a concern about this website, contact aidan@nelsonwebstudio.com with enough information for us to review it. We welcome the opportunity to resolve issues directly. Contacting us is not a requirement that prevents you from exercising a legal right or meeting a legal deadline.

We may restrict website access when reasonably necessary to address misuse, security threats, or legal requirements. This does not automatically cancel a client agreement or remove obligations under it.

Nothing in these terms limits mandatory consumer protections or other rights that cannot be waived. If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.

12. Updates and contact

We may revise these terms as the website, services, or legal requirements change. We will publish the revised version on this page and update the date above. Material changes will receive additional notice where required by law. Revisions do not automatically change an existing client agreement or apply retroactively to an earlier dispute.
